By completing this online form you are agreeing to our fair and reasonable terms of business as set out below. No variation or modification to these terms shall be effective unless agreed by both parties in writing. Any breach of any condition renders the contract void.
Booking Fee
The booking fee is £300 and is a non-refundable date retainer. This secures the time and services of the photographer for the date of your wedding. The booking fee is non-refundable in the event of cancellation.
Payment of the balance
Following payment of the booking fee, the remaining balance is payable 14 days prior to the wedding date. This balancing payment will include any mutually agreed expenses for travel and accommodation, where applicable. No photographic services or images will be delivered until the wedding fee is paid in full. After the wedding, payment for reprints, enlargements, parents albums, album upgrades etc, is made at the time of order. All Credit Card settlements will incur a surcharge of 1.75% of the transaction value (3% AMEX).
Advanced Payment
Any advanced payment made before the payment of final balance is due is non-refundable.
Coverage
Attendance will commence 3 hours prior to the start of the wedding ceremony and end 3-4 songs after the first dance. A maximum of 10 hours is included in the fee. Any additional time above and beyond this will be charged at £150 per hour.
Turnaround Time & Dispatch
Turnaround time for completion of the edits is 3-4 weeks from the date of the wedding. Uploading of the images to our website will occur within a similar time frame. Images will normally be online for a maximum of 12 months. Please ensure as far as possible that all orders from family and friends have been submitted within this time frame. Turnaround time for album orders is normally 4-6 weeks. Dispatch is normally by 1st class post within the UK. Postage of any item overseas will incur additional costs which will be quoted on a case by case basis.
Display & Copyright
Andy Taylor Photography may display any photographs included in this contract in an appropriate and professional manner within his premises, portfolios, websites, marketing literature, exhibitions & competitions. Please note that any image whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. The copyright of images is retained at all times by Andy Taylor.
Colour
We will always aim to provide an accurate and pleasing colour balance but cannot in all cases guarantee precise colour matching, and also from print to print, owing to various factors such as (i) presence of artificial light sources on location and their intensity (ii) light reflectance caused by a combination of certain dyes and materials especially, man-made fibres (iii) colour calibration variances at photo-labs.
Inherent Qualities: Photographs may fade or discolor over time due to the inherent qualities of dyes, inks and materials and agrees to release the photographer/s from any liability for any claims based upon such fading or discoloration. Prints made at different times, from different cameras, or from digital media vs. film, are expected to have variations from each other in color balance and finish.
Retouching
The set of images presented to you, after in-house editing and retouching, represent the final set of images. Any additional digital image retouching, digital manipulation and artist finishing is available as an additional service at a minimum rate of £50/hr.
The proportion of images supplied in colour vs black & white
The photographer alone will use his experience and creative judgement as to which images will be presented in colour or which images in black & White. The photographer will be the sole decision maker in that regard. Due to many factors (lighting issues / colour balance / creative reasons) which go into determining whether an image could / should be presented in colour vs black & white, transforming an image from one to the other may not be possible. And where possible will incur a per image charge of £10.
Editing and selection of images
The selection process that determines which images will be included in the final proofs set and presented to the bride and groom will be carried out solely by the photographer. Any image which is deemed not to meet the artistic standards of the photographer will not be supplied in the proofs set or offered for viewing. The photographer’s decision is final. No dispute will be entered into.
Reorders
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing. All orders for reprints require full payment with the order.
Archiving of Images & Storage
We do not guarantee to keep the images for longer than 12 months after the wedding date. NOTE* We do not archive your images indefinitely. Please ensure as far as possible that all photo/products orders are submitted within 12 months of the wedding date. Any order submitted outwith this period is not guaranteed to be fulfilled. Further, it is recommended that the images on any CD/DVD/USB supplied to you, be resaved to new media once a year to help insure continued readability. Store any CD/DVD/USB in a protective case and in a dark, stable environment. We do not guarantee the integrity of any media not maintained in our possession.
License
The Photographer/s shall be granted artistic license in relation to the poses photographed and the locations used. The Photographers’ judgment regarding the locations/poses and number of images taken shall be deemed correct. By signing this booking form you have agreed to allow the photographer complete freedom to photograph your wedding as he sees fit and to the best of his ability as circumstances allow.
Force majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by the photographer owing to any cause or event beyond his control.
Attendance
In the unlikely event of the assigned photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf.
Limitation of Liability
Further, in the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Obstructions to performance
(i) The photographer is not responsible for lost or undesirable images due to obstruction or interference by guests or other vendors with cameras. Further due to the limited, subjective and unpredictable nature of each wedding, we cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from schedule complications/late running caused by but not limited to, members of the wedding party, guests, other vendors, venue restrictions. Further, the Photographer is not responsible for the lack of coverage due to adverse weather conditions. It is also acknowledged that any lists submitted to the photographer will be used for prompting purposes only and in no way represents a guarantee that those precise images can or will actually be produced. The photographer will do their absolute best to fulfill all requests but, due to the possibility of adverse factors listed above, we cannot guarantee the listed images will be delivered.
(ii) We cannot guarantee the appearance or the frequency of appearance of any family member or guest. Factors such as the willingness of the subjects to be photographed, their elusiveness on the day, intentional or otherwise, coincidental positioning relative to the photographer throughout the day, late running and other unforeseen factors may all lead to an uneven spread of coverage family to family, individual compared to individual. Please ensure all significant guests members are listed on a ‘groupshot list’ and handed to your photographer.
Exclusivity
Andy Taylor Photography will be the sole professional photographer(s) responsible for conducting wedding photography on the day of the wedding. Attendance of any photographer, professional or otherwise, who conducts photography or who provides a service approaching that of professional wedding photography, without our consent, will immediately render this contract void.
Cancellation & Postponements
The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. In addition, cancellations which occur within 14 calendar days from the wedding date, will result in payment for the contracted wedding services in full. All cancellations must be in writing and will be confirmed as cancelled on the date the cancellation letter is received.
ALBUMS UPGRADES
1. It is agreed from the outset that the photographer is allowed full artistic license to create this storybook layout to the best of his own ability. Further, the photographer may utilise as many or as few images as he deems necessary to best illustrate the story of the wedding day. He may include/exclude/edit and enhance any image from the entire proofs set.
2. Following review of the initial storybook design, up to 50 amendments can be requested by the bride and groom over two submissions without charge. ‘Amendment’ meaning the addition, deletion, substitution or repositioning of a single image. Further amendments of this nature, or the redesign of the entire album will be charged at £50 per hour.
3. The bride & groom can make two submissions of amendments to the storybook design.
4. It is agreed that the bride & groom have previously reviewed examples of the photographer’s work and fully accept and are prepared for the photographer’s style, approach and storybook design methods.
5. Parents albums will be precise replicas of the main album.
